Texas Municipal Tree Definitions

Raising

 

El Paso

is the selective removal of branches to a predetermined height to provide vertical clearance for pedestrian or vehicular traffic.

 

Reduction

 

El Paso

is the selective pruning to decrease height and/or spread of the crown.  Consideration shall be given to the ability of a species to tolerate this type of pruning. This type of pruning is done to minimize the risk for limb failure, for utility line clearance, or to remove vegetation away from buildings or other structures.

 

Removal

 

Austin

means an act that causes or may be reasonably expected to cause a tree to die, including: uprooting; severing the main trunk; damaging the root system; and excessive pruning.

 

Cedar Hill

removal, as applied to protected trees, means uprooting, severing the main trunk of the tree, or an act which causes, or may reasonably be expected to cause, the tree to die including, but not limited to, damage inflicted upon the root system by machinery, storage of materials, or soil compaction; substantially changing the natural grade above the root system or around the trunk; excessive pruning; or paving with concrete, asphalt, or other impervious materials in a manner which may reasonably be expected to kill the tree.

 

Fort Worth

the cutting, destroying, removing, moving, poisoning, banding, marking, or effectively destroying through damaging, any tree six (6) inches or greater in diameter, regardless of species, situated on property regulated by the Zoning Ordinance without first obtaining an Urban Forestry Plan / Permit from the City Forester.

 

League City

shall mean the physical removal of a tree or causing the death of a tree through damaging, poisoning, or other direct or indirect action.

 

Lockhart

as applied to protected trees, means uprooting, severing the main trunk of the tree or any act which causes, or may reasonably be expected to cause, the tree to die, including but not limited to damage inflicted upon the root system by machinery, storage of materials, or soil compaction; substantially changing the natural grade above the root system or around the trunk; excessive pruning; or paving with concrete, asphalt, or other impervious materials in a manner which may reasonably be expected to kill the tree.

 

Mesquite

removal, as applied to protected trees, means uprooting, severing the main trunk of the tree or any act which causes, or may reasonably be expected to cause, the tree to die including but not limited to damage inflicted upon the root system by machinery, storage of materials or soil compaction; substantially changing the natural grade above the root system or around the trunk; excessive pruning; or paving with concrete, asphalt, or other impervious materials. Transplanting a tree to a location on the same property shall not be deemed removal, provided that the tree survives for a period of at least twelve (12) months. The removal of broken limbs or the removal of a protected tree that has been uprooted or has a broken trunk shall be allowed without application for a removal permit, provided that the removal is effected before the beginning of the tenth business day following the occurrence of the damage and provided further, that the period may be extended in the case of widespread and extensive storm damage.

 

New Braunfels

as applied to trees means uprooting, severing the main trunk of the tree or any act which causes, or may reasonably be expected to cause the tree to die, including but not limited to, damage inflicted upon the root system by machinery, storage of materials, or soil compaction: substantially changing the natural grade above the root system or around the trunk; excessive pruning; or paving with concrete, asphalt, or other impervious materials in a manner which may reasonably be expected to kill the tree.

 

Oak Point

an act or activity that causes or may be reasonably expected to cause a tree to be removed, damaged, cut, injured or destroyed including, but not limited to, uprooting, severing the main trunk, damaging the root system, and excessive pruning.

 

Paris

removal as applied to protected trees means uprooting, severing the main trunk of the tree or any act which causes, or may reasonably be expected to cause the tree to die, including but not limited to, damage inflicted upon the root system by machinery, storage of materials, or soil compaction; substantially changing the natural grade above the root system or around the trunk; excessive pruning; paving with concrete, asphalt, or other impervious material in a manner in which may reasonably be expected to kill the tree.

 

Round Rock

shall mean uprooting, severing the main trunk of the tree, or any act which causes or may reasonably be expected to cause the tree to die, including, without limitation, damage inflicted on the root system by machinery, storage of materials or soil compaction; substantially changing te natural grade above the root system or around the trunk; excessive pruning; or paving with concrete, asphalt, or other impervious materials in a manner which may reasonably be expected to kill the tree.

 

The Colony

as applied to protected trees, shall mean the uprooting or severing of the main trunk of the tree, or any other act which causes or may reasonably be expected to cause the tree to die, including but not limited to damage inflicted upon the root system by machinery, storage of material, or soil compaction; substantially changing the natural grade above the root system or around the trunk; excessive pruning; or paving with concrete, asphalt, or other impervious materials in a manner which may reasonably be expected to kill the tree.

 

Remove or Seriously Injure

 

Dallas

means an intentional or negligent action that will more likely than not cause a tree to decline and die within five years of the act. Actions that constitute removing or seriously injuring a tree include, but are not limited to: cutting down a tree; excessively pruning or topping a tree; compacting the soil above the root system of a tree; changing the natural grade above the root system of a tree; damaging the root sytem or the trunk of a tree (such as by operating machinery near, or by clearing or grading the area around, the trunk of a tree); failing to repair an injury to a tree from fire or other causes, which results in or permits tree infections or pest infestations into or on the tree; applying herbicidal or other lethal chemicals; and placing nonpermeable pavement over the root system of a tree.

 

Duncanville

an act that causes a tree to decline and die within three years of the act. It includes, but is not limited to: the cutting down of a tree; a compaction of soil above the root system of a tree; a change of the natural grade above the root system of a tree; and injury to a tree from fire or other causes which results in or permits infections or pest infestations; an application of herbicidal or other lethal chemicals; and placement of nonpermeable pavement over the root system of a tree.

 

West University Place

means to cut down, or remove a tree by any other means.

 

Right of Way

 

West University Place

includes all parts of a street area, including: (1) The paved or improved roadway; (2) The sidewalks; (3) The curbs or ditches; and (4) All other paved or unpaved areas in the street area. The "right-of-way area" for an individual site includes only the area between the property line of the site and the centerline of the street area (i.e., the directly abutting area in the street area). A corner site has a right-of-way area both in front and on the side.

Right of Way, Public

 

Beaumont

the entire strip of land lying between the property line and a street or thoroughfare, alley, crosswalk, or easement.

 

Root Collar

 

Houston

means an encircling structure of band-like markings or a marked color change (from the tree bark) located at the highest part of a root system joining into the trunk of the tree at or slightly below the surrounding soil line.

 

Stafford

means an encircling structure of band-like markings or a marked color change (from the tree bark) located at the highest part of the root system joining into the trunk of the tree at or slightly below the surrounding soil line.

 

Tomball

shall mean an encircling structure of band-like markings or a marked color change (from the tree bark) located at the highest part of the root system joining into the trunk of the tree at or slightly below the surrounding soil line.
